User Agreement: By accessing or using Emoji Slap (the “Service”), operated by Enigma Design Group (“we,” “us,” or “our”), a corporation organized under the laws of Wyoming, USA, you agree to these Terms and Conditions (“Terms”) and our Privacy Policy. If you do not agree, do not use the Service. Continued use after updates constitutes acceptance.
1. Acceptance of Terms
By accessing or using Emoji Slap, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Description of Service
Emoji Slap is a casual, fast-paced emoji-slapping game available on the web at emojislap.com and app.emojislap.com, and as an iOS application on the Apple App Store. Anyone can play as a guest without an account. Optional account creation enables saved high scores, leaderboards, ad-free upgrades, and other paid features.
3. Eligibility & Age Requirements
- You may play the Service anonymously (without an account) at any age.
- To create an account, you must be at least 13 years old. The Service complies with the U.S. Children’s Online Privacy Protection Act (COPPA) by not knowingly collecting personal information from children under 13.
- If you are between 13 and the age of majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed and accepted these Terms on your behalf.
- By creating an account, you represent that the information you provide is accurate and that you meet the eligibility requirements.
4. User Accounts & Security
- You may create an account using email and password or via Google Sign-In.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- You must notify us promptly of any suspected unauthorized use.
- Accounts are for individual use only. Sharing credentials or letting another person access your account is not permitted.
- We may suspend or terminate accounts that violate these Terms.
5. Acceptable Use
You agree NOT to:
- Use cheats, hacks, modified clients, macros, or any automated tools to play the Service or manipulate scores or leaderboards.
- Attempt to reverse-engineer, decompile, or extract source code or assets from the Service.
- Attempt to bypass usage limits, content moderation, age gates, or any other access controls.
- Use the Service for any unlawful purpose or to harm, harass, or impersonate others.
- Upload or transmit viruses, malware, or any malicious code.
- Interfere with or disrupt the Service, its servers, or networks (including spam, denial-of-service attempts, or excessive automated requests).
- Scrape, copy, or republish significant portions of the Service or its content without our written permission.
- Create multiple accounts to circumvent restrictions, bans, or rate limits.
6. In-App Purchases & Payments
- On the web: One-time purchases (such as “Go Ad Free”) are processed through Stripe. By purchasing, you authorize Stripe to charge your payment method. Stripe’s terms apply at stripe.com/legal.
- On iOS: In-app purchases are processed through Apple’s App Store using Apple’s StoreKit. Apple’s Media Services Terms apply.
- Purchases unlock features on the platform on which they are bought, for the account associated with that purchase. Cross-platform transfer of entitlements is not guaranteed.
- Prices are listed in U.S. dollars (or the equivalent local currency set by the platform) and may change with notice.
- All sales are final and non-refundable except as required by law or by the platform’s refund policy. For Apple App Store purchases, contact Apple directly. For Stripe-processed web purchases, contact us at the email below.
7. Advertising
The Service is supported in part by advertising. Web ads are served by Google AdSense. Mobile ads (if and when enabled) are served by Google AdMob. Users in jurisdictions requiring it, or users who have not consented to personalized advertising, will see non-personalized ads only. Users can remove advertising entirely by purchasing “Go Ad Free.”
8. User-Submitted Content
- You retain ownership of content you submit (high scores, leaderboard names, etc.).
- By submitting, you grant us a worldwide, royalty-free, non-exclusive, perpetual license to use, display, host, and modify such content for the purpose of operating and promoting the Service.
- Leaderboard names must not contain hate speech, harassment, profanity, sexual content, or content that violates the rights of others. We may remove or replace any submitted content at our discretion.
9. Intellectual Property
- Emoji Slap, including its game design, code, art, audio, “EMOJI SLAP” trademarks, and other proprietary materials, is owned by Enigma Design Group and protected by U.S. and international copyright and trademark laws.
- You may not copy, modify, distribute, sell, or reverse-engineer any part of the Service without our written permission.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR MEET YOUR REQUIREMENTS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENIGMA DESIGN GROUP AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOSS OF DATA, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $50 USD, WHICHEVER IS GREATER.
12. Indemnification
You agree to indemnify, defend, and hold harmless Enigma Design Group and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
13. Termination
We may suspend or terminate your access to the Service at any time, without notice, for any reason, including suspected violation of these Terms. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.
14. Game Content & Theme
The Service features cartoon-style emoji-slapping gameplay in a lighthearted, non-graphic manner. It is intended for entertainment only and does not promote or endorse real-world violence, harassment, or harm.
15. Governing Law & Jurisdiction
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service shall be brought exclusively in the state or federal courts located in Wyoming, and you consent to personal jurisdiction there.
16. Changes to These Terms
We may update these Terms from time to time. The “Last Updated” date above will reflect the most recent revision. Material changes will be communicated through the Service or via email when reasonably practical. Continued use of the Service after changes constitutes acceptance of the updated Terms.
