Terms and Conditions

1. Acceptance of Terms

These Terms and Conditions (“Terms”) govern your use of the Emoji Slap mobile app (the “App”) and the website at emojislap.com (together, the “Service”), operated by Enigma Design Group Inc (“we,” “us,” or “our”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the Service.

2. The App

Emoji Slap is a casual, single-player arcade game distributed through the Apple App Store. It is designed for entertainment, does not require an account, and stores your scores and settings locally on your device. The website at emojislap.com is the official informational and support site for the game.

3. Eligibility (Ages 13+)

The App is intended for users aged 13 and older. It is not directed to children under 13, and we do not knowingly collect personal information from children under 13 (see our Privacy Policy). If you are under the age of majority where you live, you should review these Terms with a parent or guardian.

4. License

Subject to these Terms and to Apple’s Licensed Application End User License Agreement (the “Apple Standard EULA”), we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use one copy of the App on any Apple-branded device that you own or control, as permitted by the App Store Usage Rules. These Terms supplement, and do not replace, the Apple Standard EULA; if there is a conflict regarding the license to use the App, the Apple Standard EULA governs to the extent of that conflict.

5. Apple App Store Terms

Because the App is distributed through the Apple App Store, you acknowledge and agree that:

  • These Terms are between you and Enigma Design Group Inc only, and not with Apple. Apple is not responsible for the App or its content.
  • Apple has no obligation to provide maintenance or support for the App.
  • If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price you paid for the App (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
  • Enigma Design Group Inc, not Apple, is responsible for addressing any claims relating to the App, including product liability, failure to meet legal or regulatory requirements, consumer protection claims, and claims that the App infringes a third party’s intellectual property.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting,” and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • You must comply with any applicable third-party terms (for example, your wireless data plan) when using the App.

6. Advertising

The App is free and supported by advertising served through Google AdMob. Ads are provided by third parties, and we are not responsible for their content or for any product or service they promote. How advertising data is handled is described in our Privacy Policy.

7. In-App Purchases

The App may offer optional in-app purchases, such as an ad-free option, additional game modes or levels, cosmetic items, and similar unlocks. These are one-time purchases (non-consumable) that unlock features for the Apple ID used to buy them; the App does not currently offer auto-renewing subscriptions. Any purchases are sold and processed by Apple through the App Store under Apple’s terms, priced in your local currency. Because these unlocks are non-consumable, you can restore previously purchased items on a device signed in to the same Apple ID using the App’s “Restore Purchases” option. All purchases are final except where a refund is required by law or granted by Apple under its policies; refund requests for App Store purchases are handled by Apple, not by us. If a feature is described as a purchase but is not yet available in your version of the App, that feature remains inactive until released.

8. Acceptable Use

You agree NOT to:

  • Use cheats, hacks, modified clients, macros, or automated tools to manipulate scores or game progress.
  • Reverse-engineer, decompile, or extract source code or assets from the App, except where permitted by law.
  • Use the Service for any unlawful purpose, or to harm, harass, or impersonate others.
  • Upload or transmit viruses, malware, or malicious code, or interfere with the Service or its networks.
  • Copy, scrape, or republish significant portions of the Service without our written permission.

9. Intellectual Property

  • Emoji Slap, including its game design, code, art, audio, and the “EMOJI SLAP” name and marks, is owned by Enigma Design Group Inc and protected by U.S. and international law.
  • You may not copy, modify, distribute, sell, or reverse-engineer any part of the Service without our written permission.

10. Game Content & Theme

The App features cartoon-style, emoji-slapping gameplay in a lighthearted, non-graphic manner. It is intended for entertainment only and does not promote or endorse real-world violence, harassment, or harm.

11. Health & Safety (Photosensitive Seizure Warning)

A very small percentage of people may experience seizures, blackouts, or other symptoms when exposed to certain flashing lights, patterns, or visual effects, even with no prior history of epilepsy or seizures. Emoji Slap contains flashing lights and rapid visual effects. If you or anyone in your family has an epileptic condition or has experienced seizures of any kind, consult a doctor before playing.

Stop playing immediately and consult a medical professional if you or anyone playing experiences any of the following: dizziness, altered vision, eye or muscle twitching, loss of awareness, disorientation, involuntary movements, or convulsions.

To reduce the risk, play in a well-lit room, do not sit too close to the screen, take regular breaks, and stop if you feel tired or unwell. The App includes a Reduce Flashing setting that minimizes flashing effects for photosensitive players; however, we cannot guarantee that all flashing or rapid visual effects are eliminated.

The App is provided for entertainment only and is not a substitute for professional medical advice. By using the App, you acknowledge that you have read this warning and assume the risks described above. To the maximum extent permitted by law, Enigma Design Group Inc is not responsible for any health effects arising from your use of the App. This warning supplements, and does not limit, the disclaimers and limitation of liability below.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENIGMA DESIGN GROUP INC AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOSS OF DATA, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR $50 USD. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.

14. Indemnification

You agree to indemnify and hold harmless Enigma Design Group Inc and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

15. Termination

We may suspend or terminate your access to the Service at any time, without notice, for any reason, including suspected violation of these Terms. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.

16. Copyright & DMCA Notice

If you believe content in the Service infringes your copyright, send a notice that complies with 17 U.S.C. § 512(c)(3) to info@emojislap.com, including your signature, identification of the work and the infringing material, your contact information, a good-faith statement, and a statement under penalty of perjury that you are authorized to act for the rights owner.

17. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-laws principles, and any dispute shall be brought exclusively in the state or federal courts located in Wyoming. Nothing in these Terms removes mandatory consumer-protection rights you may have under the laws of your country of residence.

18. Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date below reflects the most recent revision. Material changes will be communicated through the Service where practical, and continued use after changes constitutes acceptance.
